This Holiday Season: An Advance Parole Reminder

With the holiday season here once again, we remind our readers that individuals who fall into certain categories must obtain Advance Parole from USCIS before traveling abroad. This is the case if you have:
  • been granted Temporary Protected Status (TPS);
  • a pending application for adjustment of status to lawful permanent resident;
  • a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
  • a pending asylum application; or
  • a pending application for legalization.
To obtain Advance Parole, individuals must file Form I-131, Application for Travel Document. For more information, check out our press release on advance parole from last year.

sorry to repeat again but can you allow all the I-140 approved pettion holder to apply for EAD and AP21?

To Director of USCIS,

I have seen the RIN number published in the Reginfo.gov for the pre-registration process for I-1485. The same initiative was raised in 2009 but never implemented.

Also some open questions.
1. Will USCIS allow the EAD and Advance parole?
2. Will USCIS automatically pull the applications from Pre-485 application to I-485 stage?

Why does it take 90 days to process Advance Parole? Can this process be expedited?

I hope RIN number published in the Reginfo.gov can pass so that people who are stuck with cutoff dates and not able to file 485 can move on their Legal immigration(individuals who followed the law) journey

This is all because of sen grassley who sends letter to USCIS director Mayorkas and he takes it serious. this sen is a weed to all immigration community and unfortunately he is from IOWA state.

All this enforcement this RFEs is because of this senator. immigrant community should educate this kind of ignorant people as early as possible.

Applied EAD since last 90 days. In last two weeks, got e-mail two time at the interval of one week that "Card is in Production". After each e-mail, I checked the status and it was in "Card Production". Today again I checked the online status at USCIS website, the status went back from "Card Production" to "Post decision activity". Not sure what is going on? Something fishy and I feel like somebody is playing a game and making delay intentionally. May be I am wrong but it looks like something strange is going on.

On first hand, why it should take more than 90 days just to approve EAD or AP when hefty fees already collected immidiately? Somewhere I read other day which is very interesting.

I would like to know if my goverment knows that its American Citizens who are paying all these fees they keep increasing. Were already poor trying to take care of everything while u keep our spouses in there countries instead of making this process easier u just make it more difficult.10 months ago I filed an I 360 on behalf of my grandson who I have guardianship over and gotten no response what so ever my money order will be no good after Nov 19th what is going on. Is there anyone really working in these offices

This fiscal year, please give the spill over visa numbers to EB-3 China, India and Mexico to remove the huge gap between them and other categories. These are legal people waiting on line with lot of patience and they are worth getting this reward. All EB-3 people are not just skilled labors they are also people with high talents and good education and are forced to file in EB-3 because of their employment situation. These talents are highly needed for the growth of this great nation USA. I am sure this can be done with an administrative fix from USCIS and does not need involvement of Congress Politics. Thank you all for the great service you are doing to clear this backlog.

Why oh why isnt this a deterrent to anyone thinking about commiting a crime. Parole is like reporting to a parent, but that parent can throw you in prison.

Based on current estimate of the processing time (effective 8/30/2010), it will take 3 months to process AP. This reminder was first posted on 10/19/2010. Don't you think this is a bit late? It is very kind of USCIS to remind us, but it will serve a better purpose if USCIS can simply improve its efficency.

We can see how advance parole from USCIS is required for most of those cases listed.
But how does 'a pending application for legalization.' warrant an individual to require advance parole? Like the first poster said, you know you're not in control when you have to apply and fill out paperwork just to go on holiday!!

Hello USCIS officials

On this holiday season please give a relief to long backlogged EB3 category .Move the the dates and process their Green card applications.
Americans Give lot of charities during this time of the year please all you emplyoee give charity of your extra hours in processing those applications.
EB3 families will give you much more blessings than any other charities you think of.
Giving charities of toys and clothes at churches . And other hand sucking on immigrant hard earned money in form of fees is not that God will appericiate.

Making discrimination on humans Feelings and families on bases of EB2 and EB3 category , is like justifying slavery on your own formed bases of rich EB2 category and Poor EB3 people. God will not accept it.

Please treat everybody fairly and equally. And for God sake dont take new applications alluring Immigrants from poor countries to come to your country and serve you your purposes on otherhand making them seperate from their families in home country( mother, sister,brother ,kids, wife....)
first clear the backlogged EB3 applications and than take New.

At the processing rate all types of visa's are undergoing.. may need to file now to travel in June. I think the delay is mostly paperwork simply because of the number of times information is repeated across forms, and copies of documents needed. Is there a central database? I ask this because of all the repeated information given across the numerous forms needed to file. Honestly, I counted. By the time the K-1 process is completed, green card in hand, I will have listed my personal biographical information 12 times and have provided more than 7 passport-style photos to the SAME government lockbox facility.

Dear Mr.Mayorkas,

EB2 Applicants are waiting for so many years. As you are aware the positions and Qualifications are specially deemed for the Position. I am personally a PHD holder and Dual master completed with 10 years of experience. My Job required me to file for EB2 but I am waiting for years because , EB3 People are jumping the line and getting ahead of me. I am not blaming a single country but policy should be strict to make sure that EB3 Applied pettition are go into AUDIT Every single TIME and they are not adjucated unless they are through.

Most of the time the fraud is 90% of the cases where the EB3==> EB2 conversions are happening.

Please look into the issue.

If you do not like to follow the rules and regulations, write to your congresman and ask him/her to changes the rules and regulations; or you can excercize your right to leave the country.

The thing is, Anonymous, most of these rules/regulations have been put into place before most of us were born. Also, maybe you've been out of the country for the last 100 years, because that's about how long it's been since congressmen and senators have actually listened to their constituents.
