Getting onto the List of Free Legal Service Providers



All individuals in immigration proceedings are provided a copy of the “List of Free Legal Service Providers.”  This list is maintained by the Office of the Chief Immigration Judge and contains information on attorneys, bar associations, and certain non-profit organizations which are willing to provide free legal services to indigent individuals in immigration proceedings. See 8 C.F.R. § 1003.61.  While law firms are not permitted to be placed on the list, individual attorneys can apply pursuant to 8 C.F.R. § 1003.61(a)(4).

If you wish to be included on the List of Free Legal Service Providers, please refer to the application process set forth in 8 C.F.R. § 1003.63.  The application, in letter form, should state on which Immigration Court’s list you wish to appear (e.g., San Diego Immigration Court), and must include a certificate of service to the Court Administrator for each requested Immigration Court (a “cc” copy is not considered a certificate of service).  Additionally, all applications must be accompanied by a signed declaration by the individual requesting placement on the list. See 8 C.F.R. § 1003.63. The lists are updated quarterly (January, April, July, October), and all applications should be submitted at least 2 months prior to the end of the quarter in which you are requesting to be placed on the list.  A list of the various Immigration Courts, including their addresses and phone numbers, can be found on EOIR's website.  Applications should be submitted to the attention of Scott Rosen, Chief Counsel, at:

The List of Free Legal Service Providers is not to be used for the purpose of solicitation.  Individual attorneys seeking placement on the list are expected to provide pro bono legal services in all locations where they wish to be placed. See 8 C.F.R. § 1003.65.
