Smith, CPCA City of Virginia Beach Department of Permits and Inspections Municipal Center Virginia Beach, Virginia 23456-9039 Dear Mr. Smith: This letter responds to your correspondence regarding the application of the Americans with Disabilities Act (ADA) regarding accessibility requirements for new construction of a self-storage facility. The ADA authorizes the Department of Justice to provide technical assistance and information to individuals and entities who have questions about the Act or the Americans with Disabilities Act Accessibility Guidelines (ADAAG). This letter provides informal guidance to assist you in understanding and complying with the ADA accessibility standards. However, this technical assistance should not be viewed as legal advice or a legal opinion about your rights or responsibilities under the ADA. All self-storage units in a newly constructed single story storage facility are required to be accessible in compliance with ADAAG minimum standards. Section 4.1.1 establishes the application of the minimum standards and also lists limited specific instances where full compliance is not required. Design and construction of all spaces and elements of public accommodations and commercial facilities must comply with all applicable standards unless specifically allowed as exceptions. Please feel free to contact the Public Access Section any time you have questions or need information. The Department maintains a telephone information line to provide technical assistance regarding the rights and obligations of individuals, businesses, agencies, and others covered or protected by the ADA. cc: Records, Chrono, Wodatch, Breen, Harland, FOIA, Library n:\udd\mercado\plcrtltr\smith.ewh 01-01935 - 2 - This technical assistance is available by calling 202-514-0301 (voice) or 202-514-0383 (TDD) between 1:00 p.m. and 5:00 p.m., Monday through Friday.
