The owner of Webster, Texas-based Reliance
Healthcare Services, Inc. was indicted today by a Harris County grand jury for
misappropriating $2,700 in employee contributions owed to the company's health
plan.
Reliance Healthcare Services is a defunct home
health care agency which provided home health care services to local clients.
The health plan was governed by the Employee Retirement Income Security Act
(ERISA).
David Gibson was charged with misappropriating the
employees contributions to the health plan for the months of July through
September 1998 by retaining the funds in the corporate checking account and
using the money to operate the business. At the time of his improper act,
Gibson was responsible for withholding employee contributions and forwarding
those contributions to the insurance provider in the form of premium
payments.
The case resulted from an investigation conducted
by the Dallas Regional Office of the Labor Department's Pension and Welfare
Benefits Administration and the Harris County District Attorney's Office. The
case is being prosecuted by Assistant District Attorney Tracey Tirey, of the
Harris County District Attorney's Office.
