Parties in certain types of cases before the DAB's Appellate and Civil Remedies Divisions may file case-related documents electronically using DAB E-File. Filing a document electronically does not relieve the filer of its obligation to serve the document on other parties to the case. However, if all parties in a case have elected to submit case-related documents electronically, then the filing of a document with the Board via DAB E-File will constitute service of that document by the filer on the other party or parties. A non-Federal party may elect to file a document by postal delivery or other physical means instead of using DAB E-File. The DAB recommends, however, that parties with the capability to file documents electronically use DAB E-File when permitted.
In order for a party to use DAB E-File, the party's representative must first become a registered user by registering. Upon completion of registration, the party may access DAB E-File from its log in page using the e-mail address and password provided in the registration process. Please note that sending documents to the Appellate Division or Civil Remedies Division by e-mail instead of using DAB E-File, does not constitute electronic filing.
To be considered timely filed, documents filed electronically must be uploaded to DAB E-File by 11:59 P.M. Eastern Time on the day that the filing is due with either the Appellate Division or the Civil Remedies Division.
The use of DAB E-File to file a document fulfills any signature requirement applicable to the party representative who made the filing. (The e-mail address and password used by the representative to access DAB E-File will serve as the filer's electronic signature on documents that would ordinarily contain or are required to contain the filer's signature.) The electronic copy of a document authored by a person other that the party's representative — for example, a witness affidavit or declaration — must be in an electronic format (typically, PDF) that captures the actual physical signature.
At all times, an electronic filer assumes the risk of all errors not solely attributable to a DAB E-File malfunction that may result in the inability to complete an electronic filing. Eastern Time, the filer should notify Mr. Banos-Diaz on the next business day and provide supporting evidence of the problem, such as a copy of an error message or screen print of an error page.
