FOIA Requests
The Freedom of Information Act (FOIA) is a Federal release statute. The FOIA provides an important means through which the public can request access to records related to the activities of the Army's Human Resources Command (HRC), unless the information is protected from disclosure by any of nine exemptions enacted by the Congress to protect information that must be held in confidence.
Military personnel records that fall under the purview of the Commander, HRC, include the following: reserve military records, active duty military records, military personnel administrative matters, personnel locator, physical disability determinations, military casualty and memorization activities, voting, identifications cards, naturalization and citizenship matters, commercial solicitation, Military Postal Service Agency, Army postal and unofficial mail service.
There are several points to keep in mind when submitting a FOIA request to HRC:
-
Under FOIA, agencies have 20 working days to provide release determination to requesters excluding Saturdays, Sundays and legal holidays.
-
FOIA fees may be charged to process your request if research and copying exceed a certain level. You would be advised of any anticipated fees.
-
It is incumbent upon the requester to provide a reasonable description and the possible location of documents needed.
-
Simple requests may be processed more quickly than more complex ones.
-
FOIA requests must be made in writing, requesters must provide a home mailing address and telephone numbers (email requests are acceptable).
-
For Privacy Act Request, there are three basic elements: First, the letter should state the request under the Privacy Act. Second, the letter should include the name, address, and signature of requester. Third the request should describe the records as specifically as possible.
