Energy Independence and Security Act, Section 432: Use of Energy and Water Efficiency Measures in Federal Buildings

FEMP is responsible for tracking Federal agency progress toward meeting Section 432 of the Energy Independence and Security Act (EISA) of 2007 for Federal facility energy and water management and benchmarking. The EISA Section 432 Compliance Tracking System (CTS) tracks agency performance of energy and water evaluations, project implementation and follow-up measures, and annual building benchmarking requirements.

The EISA Section 432 CTS accepts required Federal agency reporting on:

  • Designation and location of facilities covered by EISA requirements
  • Assignment of energy managers
  • Energy and water evaluations completed at covered facilities
  • Implementation of energy and water efficiency measures (ECMs), including estimated cost and savings
  • Follow-up status on implemented measures, including measured savings and persistence of savings
  • Building benchmarking information

The following guidance resources are available to help Federal agencies comply with EISA Section 432:

Facility Energy Management Guidelines and Criteria for Energy and Water Evaluations in Covered Facilities: Guidelines and criteria for meeting requirements within Section 432 of EISA 2007, including defining facilities covered by the provision, designating facility energy managers to ensure compliance, and conducting comprehensive energy and water evaluations.

NEW: Guidance for the Implementation and Follow-up of Identified Energy and Water Efficiency Measures in Covered Facilities: Final Guidance for the Implementation and Follow-up of Identified Energy and Water Efficiency Measures in Covered Facilities (per 42 U.S.C. 8253 Subsection (f), Use of Energy and Water Efficiency Measures in Federal Buildings). This guidance to Federal agencies pertains to the implementation and follow-up of energy and water efficiency measures identified and undertaken per Section 432 of the Energy Independence and Security Act of 2007 (EISA) (42 U.S.C. 8253(f)(4) and (5)). This guidance also provides context for how these activities fit into the comprehensive approach to facility resource (energy and water) management outlined by the statute and incorporates by reference previous DOE guidance released for Section 432 of EISA and other related documents. In addition, the statute requires DOE to establish a publically-available web-based tracking system that provides compliance data at the facility level. Under the statute, an agency can request an exemption from disclosure based on national security concerns. This guidance includes a request form and instructs agencies to submit the forms to the Secretary of Energy in care of FEMP. Requests for exemption of facility data from public disclosure are due from agencies by December 24, 2012.
