Commissioner Joseph E. Brennan, of Portland, Maine, comes to the Commission to continue a distinguished career of public service. After serving in the U.S. Army, he graduated from Boston College and the University of Maine School of Law. He became a representative in the Maine House in 1965. Mr. Brennan went on to serve as District Attorney for Cumberland County in Maine, as a Maine State Senator, and as the State's Attorney General. He was elected Governor of the State of Maine in 1979, a position he held until 1987, and also served as Chairman of the Conference of New England Governors and Eastern Canadian Premiers. He subsequently served in the U.S. House of Representatives until 1991, and then entered private practice as an attorney in Washington, D.C.

Commissioner Brennan Dissents from Majority Vote to Issue Final Rule Creating Non-Vessel-Operating Common Carrier Negotiated Rate Arrangements
On July 31, 2008, the National Customs Brokers and Forwarders Association of America, Inc. (NCBFAA) petitioned the Federal Maritime Commission (FMC) to exempt non-vessel-operating (NVO) common carriers from the statutory requirement to publish, and adhere to, tariff rates. In response to the intermediaries’ petition, the Commission initiated on its own motion the exemption that the Commission is now considering. The Commission should disapprove the exemption for two reasons.

FMC For Fifth Time Votes to Effectively Delay or Block Clean Air Program of Citizens of Los Angeles and Long Beach
By formally requesting more information from the parties, the Commission majority has prevented the LA/Long Beach Port Fee Services Agreement (FMC Agreement No. 201199) from taking effect until 45 days after the Commission receives answers from the parties. That delay prevents the collection of fees to pay for new, cleaner trucks. Commissioner Brennan voted against requesting further information.

Commissioner Joseph Brennan dissented from the Commission majority's decision to deny expedited review of the Port Services Agreement of Los Angeles and Long Beach (FMC Agreement No. 201199). Commissioner Brennan is concerned that not granting the request for expedited review will lead to the impression that the Federal Maritime Commission is oblivious or indifferent to the felt need and urgency of economic development and cleaning up the air for millions of southern Californians.

In an October 29th closed-session meeting of the Federal Maritime Commission, Commissioner Joseph E. Brennan voted against a motion to seek a federal injunction to stop the Clean Trucks Program (CTP) of the Port of Los Angeles.
