Burgess Statement on Supreme Court Ruling
“The Patient Protection and Affordable Care Act is detrimental to our society, our economy and to the future of health care in America.”

Washington, D.C. – Congressman Michael C. Burgess, M.D. (TX-26), Vice Chair of the House Energy and Commerce Committee’s Subcommittee on Health and Chairman of the Congressional Health Care Caucus, released the following statement after the Supreme Court ruled to uphold the Patient Protection and Affordable Care Act.

“The Patient Protection and Affordable Care Act is detrimental to our society, our economy, and to the future of health care in America.  Since its inception we have seen the strain it has placed on our economy through its ever increasing price tag, provisions which discourage small businesses to hire, higher costs, and excessive government regulations.  

“President Obama stated multiple times that the penalty associated with the individual mandate was not a tax; however, the Supreme Court today affirmed that indeed it was a tax.  In fact, it is a tax increase and a very large tax on middle-class America. When millions are unemployed the last thing America needs is another tax.

“This decision by the Supreme Court is paramount and signals to the House of Representatives that it is our responsibility to repeal this over burdensome law which increases taxes on middle class families, and replace it with common-sense policies that encourage economic growth and protect American’s access to care. The House has voted to repeal the legislation and will do so again next month.”

    This law was crammed down our throats from the beginning, we don't want another Government program that will break our country finacially , Obama lied that this was not a tax and it is. We the people will pay dearly in very many ways. If they lied to get the law passed, how can it stand???? I am scared

    Is Roberts on DRUGS? Nowhere does the law mention a tax as far as the mandate is concerned. SERIOUSLY he takes mind-altering drugs for epilepsy and needs to resign if he didn't see a need for a re-write of the law. I encourage everyone to collapse obamacare with your feet - REFUSE to buy a health insurance policy and them refuse the penalty - there's no punishment specified, and under obamscare you have to be treated anyway. Congressman Burgess, REFUSE to pass any debt ceiling increases. As I warned you last time, you guys were made a fool of with your supercommities and all that junk. Just do not vote for a higher spending limit. Let the government crash and burn- who needs it? It just means some buruacrats get laid off. None of your voters will even notice the government is gone because Social security checks will still go out despite Obama lies to the contrary. Above all else, WIN AT ALL COSTS -TAKE NO WARNING SHOTS. MAKE NO DEALS. AND TOSS OUT THE SPEAKER OF THE HOUSE -he is a looser. Get rid of him.

    My kid has insurance as of right now because of this law. He's a senior in college and will graduate next December, hopefully he'll find a job which provides healthcare but in case he doesn't at least he'll be covered for a few years until he does find a job. As far as the "tax" goes, I thought that it only applied to those individuals and families who could afford it but chose (for whatever reason) not to. I will not have to pay this "tax" because I am fortunate enough to have a job which provides it. For those who in the past had decided not to purchase insurance and then ended up in the emergency room and left the bill to the rest of us taxpayers, I say it's about time you started to pay!

    OBAMACARE IS A DISASTER IN THE MAKING! IT NEEDS TO BE REPEALED AND IT SHOULD HAVE BEEN KILLED OFF BY THE SUPREME COURT! WHAT A DISAPPOINTMENT ROBERTS IS.

    Yep, it's pretty horrible: Young adults can now stay on their parent’s health plan up to age 26. Some small businesses with fewer than 25 employees can get help paying for the cost of providing health insurance … Insurance companies can’t deny health coverage to kids with pre-existing conditions. Adults who have been uninsured for at least 6 months and have been denied coverage because of a pre-existing condition may now get coverage Insurance companies can’t place dollar limits on the health care they cover in your lifetime. Those in the Medicare Part D “doughnut hole” get a 50 percent discount on name-brand prescription drugs and a 7 percent discount on generic prescription drugs. Those in Medicare can get preventive services and screenings, such as mammograms and colonoscopies, at no cost to them. New health plans must offer preventive and screening services, such as mammograms and colonoscopies, at no cost to the patient. Insurance companies won’t be able to deny coverage to anyone with a pre-existing condition. Health insurance will cover essential health benefits and coverage will be guaranteed for nearly all Americans. Most Americans will be required to purchase health insurance if they don’t already have it – and depending on your income, they may get help paying for it. Insurance companies won’t be able to place dollar limits on the care they cover in a single year.Americans without health insurance will be able to buy it through state-based marketplaces called exchanges. More Americans will have access to health coverage through Medicaid. Sounds pretty good to me. The CBO (Congressional Budget Office) The Congressional Budget Office (CBO) is a federal agency within the legislative branch of the United States government that provides economic data to Congress.[1] The CBO was created as a NONPARTISAN agency by the Congressional Budget and Impoundment Control Act of 1974. Like it or not, the CBO report still shows the Affordable Care Act doing what it's supposed to do, while cutting the deficit, just as proponents argued during the debate in 2009 and 2010. The arguments Democrats made at the time are bolstered, not undermined, by the new data. Indeed, as Jonathan Cohn noted, "The real news of the CBO estimate is that, according to its models, health care reform is going to save even more taxpayer dollars than previously thought."

    I agree this legislation and subsequent SC decision confirms that additional taxes will be required to support this now re-affirmed law. Both houses of congress voted by a 60% margin to put this legislation on the Presidents desk to sign into law, and he did so. The SC has affirmed that this legislation is valid in it's present form in part because it was the will of both houses of Congress and the administration that this law be so enacted. That is how our system of government works. It has been tested by the SC and a 5 to 4 decision was handed down. The system works. Perhaps a different manner in which this decision was brought before the court would have been wiser that than bringing the whole law/act itself. But that was not done but can still be done in challenging certain parts of this Act. Additionally the Act can be revised or in total rescinded/repealed should both houses of congress wish it so. If the president veto's any part of same than both houses of congress can override his veto by a 2/3's majority accordingly. This is how our system works.

    We need our congressmen and women to fight hard against Obamacare and other bills, we all know it is not in the best interest of our country. We need to vote for those whose performance is good in our government and vote those out that are not performing to the "people's" expectations. Everyone, take at least one person with you to vote (against Obama) and his band of thieves. See you at the poles in November! We are watching.

    Congressman, as a retired Army Major I applaud the decision of the Supreme Court regarding the Affordable Care Act. It is time for you to move on and concentrate on items such as providing better VA funding and benefits to those brave folks returning from Iraq and Afganistan.

    The Republican Party of Texas’ recently adopted 2012 platform contains a plank that opposes the teaching of “critical thinking skills” in schools. The plank in question, on “Knowledge-Based Education,” reads as follows: We oppose the teaching of Higher Order Thinking Skills (HOTS) (values clarification), critical thinking skills and similar programs that are simply a relabeling of Outcome-Based Education (OBE) (mastery learning) which focus on behavior modification and have the purpose of challenging the student’s fixed beliefs and undermining parental authority. Elsewhere in the document, the platform stipulates that “[e]very Republican is responsible for implementing this platform.” I know that actual facts are something that you Republicans are averse to. How about reading some of the information that was published by the CBO as regards to the Budget and the ACA. Guess you would rather spout lies and wear your Tri Corner Hats on the street corners as you howl at the moon.

    If the bill was pushed through stating that the mandate was to be a penalty and not a tax, then why is the bill not void, since it was passed as a penalty rather than a tax?

    It would seem that if Congress, specifically the House of Representatives, didn't intend this to be a tax then it is incumbent upon the House to make that known by either repealing it or setting it at a rate so ridiculously low as to cause the mandate to fail. If the tax is to stand then establish the maximum at $1.00. Obviously, the correct thing to do is repeal the entire legislation with all of its hidden riders and mandates.

    So it's a tax. So what! The Texas system of praying at the altar of "NO TAXES" is ridiculous. Have any of you looked at the condition of your state. It a Sty. Your water, the roads,the air, the education system, your childish attitude towards politics.The number of insured is appalling.You have to pay for things in life. You can't be free loaders on the rest of the nation.Which is what Texas is. This attitude of my way or the highway is a joke. As a matter of fact where was the screaming when Bush's Medicare pill bill was passed without paying for it. Where was Burgess? Running off the cliff with the other lemmings. This country needs to have a better system for health care, for education, etc. And sometimes, you have to pay for things. Grow-UP!! As for Congressman Burgess, how can a physician have so little to show for the last 6-8 years. What have you done to better the lives of your constituents? Nothing, just follow the party line.From what I see, you put your party ideology above your love of country. My country come first, not my party or my state.

    Wake up everyone - we're all just one serious illness away from bankruptcy, or worse. Health care before this act passed was broken. The ACA reins in the corporations and prevents them from totally taking over health care. They already own the hospitals, big pharma, medical equipment, and even the doctors are now largely under their control. If this is a tax at all, it's a minor one, and many will get rebates from their insurers. I'd way rather have the government involved in health care than let corporate America have it's way with us.

    Obamacare contains riders which have little or nothing to do with health care, and are even more obstreperous than is its main thesis. Besides helping get it repealed, please do what can be done to roll back the financial damage already done by it. I have no way to fly Old Glory upside down, but I have a "Don't Tread On Me" flag which I will fly in lieu of Stars and Stripes, beginning tomorrow morning. Upon repeal of Obamacare, I will replace it with the flag from my father's coffin - he served in WWII

    I listened to an American Native talk about his experiences with the existing health care provided to the first people of the USA. This is what he said "you get up about 5:00 a.m., drive for an hour, wait in line from the time you get there so you will have a better chance of being seen. Then you might see a nurse or medical assistant about 11:00 a.m. and if you are lucky, you see a doctor about 4 :00 or 5:00 p.m.. That is assuming you will get seen that day. If you are too far back in the line, you go home and then go through the process again the next day." Your dignity is out the window and so is your wages for a day or two. A Canadian-American friend told me that the socialized health care system in Canada is okay but only as long as you don't get sick! This is what we have come to. I wish Pelosi, Obama (his entire family), Clinton (both of them) and Roberts had to use this new health care.

    So it is a tax. We need Universal Healthcare not "SickCare". It is no different than a car insurance mandate. It you get caught without car insurance your car is impounded. What is that called--a tax or penalty? The previous "Bush Administration" did nothing for the U.S. citizens re healthcare. Instead, we got 2 ugly "Wars" that we, the people are paying for. Congress poll rating is only 9%!! Wake up!! Dr. Oz stated that we cannot have a Wealthy Nation until we have a Healthy Nation!! Hope you will all work together in the future for the people.     I have seen with my own eyes, buses at a medical clinic in NH. I asked my father-in-law who was coming to the clinic in a bus. He replied, "they are from Canada". I asked him how often the bus comes. He said it was there every time he came for his appointment. This was 10 years ago. The truth is that our previous medical system was not perfect. It was just the best around. People from all over the world come to the USA for treatment. Why is that? If anyone thinks that socialized medical care works, then let them go to Cuba, Canada, UK, or wherever that employs that approach. Obamacare is all about power and money for the government and NOT for healthcare at all. It will result in poorer care and every bright young doctor will flee to the places where they can practice like they used to be able to do here, and we will be the worse in every way!

    While healthcare reform is required the government does not need to be the one who administers it. There is no government service that does not cost at least 25% more than private industry could supply. What government agency has become smaller?? The Dept of Energy has grown to a payroll now accounting for billions and has 16,000 employees. Obama's plan is another way to grow the government and all you have to do is ask a Canadian or Brit and their Socialized healthcare plan stinks. We need privatized insurance with competition between companies and the costs will go down and we won't drown in more government employees.
