The Federal Office of Child Support Enforcement and the Internal Revenue Service (IRS) have advised state child support agencies of a significant increase in the number of fraudulent income tax filings resulting in fraudulent tax refunds. The State of West Virginia Bureau of Child Support Enforcement Agency is experiencing some volume of fraudulent tax filings.

Tax refunds can be directed to the state child support agencies for past-due child support. This redirection of a tax refund is referred to as an offset. The Federal Office of Child Support Enforcement has authorized state child support agencies to hold tax refund offsets until the IRS completes their investigations.

NEW LEGISLATION AFFECTING EMPLOYERSNew
EFFECTIVE ON JUNE 5, 2012

West Virginia Code § 48-18-125 new hire reporting requirements will apply to INDEPENDENT CONTRACTORS in the same manner as employees. Effective June 5, 2012, all employers must report the hiring, rehiring, or return to work of all INDEPENDENT CONTRACTORS who receive compensation or execute a contract for services performed for that employer when payment for services equals or exceeds $2500.00 in any year. The reporting must be done at the time the contract is executed or the first payment, whichever is earlier.

CHANGES AFFECTING CLAY COUNTY BCSE OFFICE

Effective March 1, 2012, the following changes will occur in the Bureau for Child Support Enforcement’s Clay County office, located at 131 Main Street, Clay, West Virginia:

  • Office hours will be from 9:30 a.m. to 3:30 p.m. each Tuesday.
  • All correspondence will now be reviewed in the Bureau for Child Support Enforcement Braxton County Office at 1936 Sutton Lane, Sutton, WV 26601. All correspondence must be mailed to this address.
  • Telephone inquiries will be received at the Bureau for Child Support Enforcement’s Braxton County office. To schedule an appointment, or to speak to your caseworker, call 304-765-0430.

Customer inquiries may also be made by calling the Bureau for Child Support Enforcement’s Customer Service Unit at 1-800-249-3778 or by accessing the Bureau for Child Support Enforcement’s website at: www.wvdhhr.org/bcse.

SIGN-UP FOR TEXT OR EMAIL NOTIFICATIONS

There is a new option available to both those who pay support and those who receive support. You can now register to receive text or email notifications when a payment is received in your case. This eliminates the need for you to regularly check the Support Payment Information website. Click here for more information on how to sign-up for this service. There is no charge by the Bureau for this service. However, normal text or email fees may be charged by your service provider.

ELECTRONIC INCOME WITHHOLDING ORDERS (E-IWO)

There is a new option available to employers to receive IWO's electronically by using a portal developed for the Federal Office of Child Support Enforcement. This option is available to all employers. Visit the E-IWO page at the Employer Resource Center for more information.
