CBP Publishes AES Penalty Guidelines
**********************************************************************

On January 2, 2009, the U.S. Customs and Border Protection (CBP)
published Guidelines for the Imposition and Mitigation of Civil
Penalties for Failure to Comply with the Foreign Trade Regulations (FTR)
in 15 CFR Part 30. The document provides assessment and mitigation
guidelines for violations of the FTR published by the Census Bureau
on June 2, 2008.
The FTR requires mandatory filing of export information through the
Automated Export System (AES) or AESDirect for all shipments where export
information is required. The penalty provisions that will be administered
by the CBP are set forth in sections 30.71 and 30.72 of the FTR.
The guidelines are effective on February 1, 2009 for violations occurring
on or after February 1, 2009.
For additional information please contact Ms. Susan Terranova at
202-325-0009 or Mr. Christopher Pappas at 202-325-0109.
