What can I do if I believe I was harmed by servicer error during the foreclosure process?

If you had a mortgage loan on your primary residence and believe you were financially harmed during the mortgage foreclosure process in 2009 or 2010, due to an error by any of the servicers listed below, you may be eligible to have your foreclosure reviewed, and to potentially receive compensation.

You may be eligible for an independent foreclosure review if

  • the property securing your mortgage was your primary residence
  • your mortgage was in the foreclosure process (initiated, pending, or completed) at any time between January 1, 2009, and December 31,
                                                                2010, and
  • your mortgage was serviced by one of the following mortgage servicers:

BAC Home Loans Servicing Everbank/Everhome Sovereign Bank
Bank of America Financial Freedom SunTrust Mortgage
Beneficial GMAC Mortgage U.S. Bank

CitiFinancial IndyMac Mortgage Services Wells Fargo Bank
CitiMortgage Metlife Bank Wilshire Credit Corporation

Information about the review process, including instructions on how to request an independent review, is available on a website set up by the servicers, and also has been provided in mailings to borrowers who may be eligible for a review. In addition, you can get information by calling (888) 952-9105, Monday through Friday, 8 a.m. – 10 p.m. ET, or Saturday, 8 a.m. – 5 p.m. ET. There are no costs associated with being included in the review; the review is a free program. The deadline to submit a Request for Review Form is December 31, 2012.

Whether or not you are eligible for an independent foreclosure review, you may always file a complaint directly with your servicer or with the servicer's regulatory agency.
