ANNOTATION: Changes needed to address child welfare and juvenile justice systems’ tendency to “routinely subject LGBT [lesbian, gay, bisexual, and transgender] youth to differential treatment, deny them appropriate services and fail to protect them from violence and harassment” are discussed (p. 1). This article is divided into two parts: LGBT youth at home, in the community, and in the system; reforming the system through litigation, education, and policy—the use of litigation to protect LGBT youth in state custody and for reform (the constitutional right to safety, the constitutional right to equal protection, the constitutional right to free speech and freedom of religion, and state non-discrimination protections.
