Citizen of Nicaragua admits unlawful presence in U.S.

NEW HAVEN, Conn. - Nora R. Dannehy, Acting United States Attorney for the District of Connecticut, announced that Cesar Augusto Mendez-Darce, 27, a citizen of Nicaragua, pleaded guilty today before United States District Judge Janet Bond Arterton in New Haven to one count of unlawful presence in the United States following deportation. This case was investigated by ICE.

According to documents filed with the Court and statements made in court, Mendez-Darce was deported to Nicaragua on Sept. 8, 2003. In December 2006, Mendez-Darce illegally re-entered the United States near Tucson, Arizona. He was found in Hartford on March 26, 2008.

Before re-entering the United States, anyone who has been deported must have the express consent of the U.S. Attorney General or the Secretary of the Department of Homeland Security.

Judge Arterton has scheduled sentencing for Aug. 7, 2008, at which time Mendez-Darce faces a maximum term of two years imprisonment and a fine of up to $250,000.

This case is being prosecuted by Assistant United States Attorney Jonathan S. Freimann.
