Summary Information

FY 2011 Continuing Resolution On December 22, 2010, the President signed into law P.L. 111-322 making further continuing appropriations for FY 2011 through March 4, 2011. The CR extends the terms and conditions of P.L. 111-242, which funded government operations through December 3, 2010, and includes additional provision for the Department of the Interior. The rate of operations for Interior is based on the 2010 enacted funding levels, except for the Bureau of Ocean Energy Management, Regulation and Enforcement, which is authorized by Sec. 159 to fund operations at an annual rate of $365.0 million including offsetting collections and inspection fees. Public Law 111-322 includes additional provisions with impact to the Department of the Interior:

  • Section 147 freezes the pay of non-military government personnel for 2011 and 2012.

  • Section 159 provides funding authority for BOEMRE, including authority for the collection and use of offsetting collections and inspection fees.

  • Section 160 provides the Secretary authority to implement a reorganization of BOEMRE, including the establishment of accounts, transfer of funds, and other administrative actions.

  • Section 161 provides authority for geothermal payments to counties for FY 2011.

  • Section 2401(b) provides expenditure authority for the Sport Fish Restoration and Boating Trust Fund through March 5, 2011.

Section 128 of P.L. 111-242 included a rescission of $25.0 million for BOEMRE prior-year unobligated balances. The legislation includes a provision (Sec. 121) for the Bureau of Reclamation that rescinds available funding provided for drought emergency assistance in the Supplemental Appropriations Act, 2010 and reappropriates that funding with no time limitation.

Budget Amendment

On September 13, 2010, the President submitted to Congress a FY 2011 budget amendment requesting additional funding for the Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE). The budget amendment request is necessary to strengthen oversight of offshore oil and gas operations, address deficiencies in mineral revenue collection, and facilitate the reorganization of BOEMRE. The budget amendment requests an additional $100 million for BOEMRE with proposals to offset the increased cost by increasing inspection fees on onshore oil and gas operations, canceling prior-year balances not needed for the BOEMRE Outer Continental Shelf Connect project, and prohibiting the expenditure of mandatory spending authorized in the Energy Policy Act of 2005 for oil and gas research and development.

Supplemental - State Aid Package (HR 1586)

The House wrapped up a rare August session Tuesday after clearing a state aid package and passing a border security bill. President Obama signed into law the $26.1 billion state aid bill just hours after the House cleared it by a vote of 247-161. The Senate passed the measure by a vote of 61-39 on August 5, 2010. The bill would provide $16.1 billion to extend increased Medicaid payments to states and $10 billion in aid to schools to prevent layoffs of teachers and other employees. This bill includes rescissions to DOI emergency funding including:

  • BIA Recovery Act funding: Sec. 310. Of the funds made available for "Bureau of Indian Affairs--Indian Guaranteed Loan Program Account'' in title VII of division A of Public Law 111-5, $6,820,000 are rescinded.

  • NPS Hurricane Ivan funding (2004): Sec. 314. Of the funds made available for "National Park Service--Construction'' in chapter 7 of division B of Public Law 108-324, $4,800,000 are rescinded.

  • NPS Hurricane Katrina funding (2006): Sec. 315. Of the funds made available for "National Park Service--Construction'' in chapter 5 of title II of Public Law 109-234, $6,400,000 are rescinded.

  • FWS Hurricane Ike funding (2008): Sec. 316. Of the funds made available for "Fish and Wildlife Service--Construction'' in chapter 6 of title I of division B of Public Law 110-329, $3,000,000 are rescinded.


Interior, Environment and Related Agencies Appropriations
On Thursday, July 22, 2010, the House Interior, Environment and Related Agencies Subcommittee adopted the 2011 Interior, Environment and Related Agencies Appropriations Bill. The bill provides funding for Department of the Interior programs, except the Bureau of Reclamation and the Central Utah Project. The bill provides $32.2 billion, a decrease of $133 million, for agencies funded by the bill. The bill includes $11.0 billion for Interior programs in the bill, an increase of $22 million above the President's request.

Energy and Water Development Appropriations
Summary: On Thursday, July 22, 2010, the Senate Appropriations Committee adopted the 2011 Energy and Water Development Appropriations Bill by a vote of 17 to 12.

The Subcommittee legislation would provide $1.133 billion for the Department of the Interior.
This level is $25 million above the President's budget request.

  • The Department of Interior's Central Utah Project Completion Account would receive $43 million, which is the equal to the budget request.

  • The Bureau of Reclamation's Water and Related Resources account would receive $939 million, which is $25 million above the President's budget request.

  • The Bureau of Reclamation's Central Valley Project Restoration Fund account would receive $50 million, which is equal to the budget request.

  • The Bureau of Reclamation's California Bay-Delta Restoration account would receive $40 million, which is equal to the budget request.

  • The Bureau of Reclamation's Policy and Administration account would receive $61 million, which is equal to the President's request.

Senate Energy and Water Development Earmarks


On Thursday, July 15, 2010, the House Energy and Water Development Appropriations Subcommittee approved a $34.7 billion spending plan for energy and water programs, including $1.1 billion for the Bureau of Reclamation and CUPCA. The funding is equal to the FY 2011 President's request.

The House fully funded the WaterSMART program request of $62 million for FY 2011 including the requests for WaterSMART grants ($27 million), Basin Studies ($6 million), and Title XVI Water Reclamation and Reuse ($29 million).

FY 2010 Supplemental Appropriations.

On Tuesday, July 27, 2010, the House adopted the Senate-passed supplemental bill. The President signed the bill into law (P.L. 111-212) on July 29, 2010.

  • The $59 billion supplemental appropriation bill provides $5.1 billion for disaster recovery including the gulf spill. This includes $29.0 million requested by the administration for Interior incident related costs.

  • It also includes reinstatement of geothermal payments to counties and a one year extension to the Federal Lands Transaction Facilitation Act (FLTFA). The costs of these provisions of $9 million, is funded by a reduction to historical accounting in the Office of the Special Trustee.

  • Authority to fund contract claims related to recovery act projects for which funds expire September 2010 from unobligated balances is provided.

  • Emergency authority for the Coastal Impact Assistance Program, a provision to accelerate permitting of the Southwest Intertie project, and reauthorization for NPS Chesapeake Gateway.

  • The bill also extends authorities for the 1991 Reclamation States Emergency Drought Relief Act through 2012.

Status of the House and Senate Budget Resolutions

On Thursday, July 1, 2010, the House passed the FY 2011 Budget Resolution (H. Res. 1493). The measure included a Democratic "Budget Enforcement Resolution", which sets a discretionary spending cap for fiscal 2011 spending bill. The one-year budget plan was automatically adopted when the House voted 215-210 to adopt the floor rule for the fiscal 2010 supplemental bill. The measure would set the fiscal 2011 discretionary cap at $1.121 trillion, about $7 billion below the Administration's request. With the House having adopted a fiscal 2011 spending cap, House appropriators can adopt individual spending allocations for each of its 12 spending bills for fiscal 2011.

On April 15, 2011, the President signed the Department of Defense and Full-Year Continuing Appropriations Act, 2011 (P.L. 112-10). The Act provides funding for all bureaus and offices in the Department of the Interior.
