Summary - Adjustment of Civil Monetary Penalties Based on Inflation

On October 4, 2000, the Commission published a revision to the Enforcement Policy in the Federal Register (65 FR 59274) to increase the civil penalty amounts it can impose against licensees for violations of Commission requirements. The increase, mandated by Congress, adjusts fines for inflation. The maximum civil monetary penalty increases from $110,000 per violation per day to $120,000 per violation per day. The Commission also approved increases to the lesser civil penalty amounts in Table 1A of the Enforcement Policy to maintain the same proportional relationships between the penalties. This revision will soon be issued concurrent with a change to 10 CFR 2.205 to reflect the new maximum civil penalty. The new civil penalty amounts apply only to violations that occur after the date the increase takes effect.
