Man Subject to Protection Order Pleads Guilty to Possessing Firearm
US Attorney Brendan V. Johnson announced that Samuel Darrell Lane, age 27, of Sioux Falls appeared before United States Magistrate Judge John E. Simko on September 5, 2012, and pled guilty to an indictment that charged him with possession of a firearm while being subject to a domestic protection order. The maximum penalty upon conviction is 10 years in prison and/or a $250,000 fine, plus forfeiture of the firearm.
An officer of the Sioux Falls Police Department stopped Lane driving in Sioux Falls because the officer recognized Lane and knew his driver's license was suspended. The officer then located a firearm in Lane's vehicle.
The investigation was conducted by the Sioux Falls Police Department and the ATF. The case is being prosecuted by Assistant US Attorney John E. Haak.
A presentence investigation was ordered, and a sentencing date will be set.
The defendant was remanded to the custody of the US Marshal pending sentencing.
