Marvin Eric Galloway Sentenced in U.S. District Court

The United States Attorney’s Office announced that during a federal court session in Billings, on June 26, 2012, before Senior U.S. District Judge Jack D. Shanstrom, MARVIN ERIC GALLOWAY, a 29–year–old resident of Billings, appeared for sentencing. GALLOWAY was sentenced to a term of:

GALLOWAY was sentenced in connection with his guilty plea to being a felon–inpossession of firearms, possession of stolen firearms, and distribution of controlled substances.

In an Offer of Proof filed by Assistant U.S. Attorney Marcia K. Hurd, the government stated it would have proved at trial the following:

GALLOWAY was previously convicted of assault with a weapon and felony deceptive practices, which thereby prohibited him from possessing firearms.

On January 18, 2011, GALLOWAY sold an undercover agent a Benelli, model Nova, 12 gauge pump–action shotgun in Billings. The gun was reported stolen in October 2010.

On January 22, 2011, GALLOWAY sold an undercover agent a Marlin, model 917M2S, .17 caliber rifle in Billings. The gun was reported stolen on December 11, 2010.

On July 25, 2011, GALLOWAY sold an undercover agent a Bryco Arms, model Jennings Nine, 9 mm semi–auto piston with one magazine and four rounds of ammunition for $120 in Billings.

On July 26, 2011, GALLOWAY sold an undercover agent a Ruger, model LCP, .380 caliber semi–auto pistol in Billings. The gun was reported stolen the previous day.

On August 3, 2011, GALLOWAY sold an undercover agent a Walther, model P 22, .22 caliber semi–auto pistol in Billings.

On August 16, 2011, GALLOWAY sold an undercover agent a Ruger, model Blackhawk, .41 magnum caliber revolver for $60 in Billings. The gun was reported stolen in Helena on August 12 or 13, 2011.

On August 24, 2011, GALLOWAY sold an undercover agent a Ruger, model LCP, .380 caliber semi–auto pistol for $140 in Billings. The gun was reported stolen in Billings on July 1, 2011.

On December 20, 2010, GALLOWAY sold 7.6 grams of cocaine, a Schedule II controlled substance, to an undercover agent in Billings for $450.

On December 27, 2010, GALLOWAY sold 5.7 grams of cocaine, a Schedule II controlled substance, to an undercover agent in Billings for $450.

On January 21, 2011, GALLOWAY sold 7.0 grams of cocaine, a Schedule II controlled substance, to an undercover agent in Billings for $460.

Because there is no parole in the federal system, the truth in sentencing guidelines mandate that GALLOWAY will likely serve all of the time imposed by the court. In the federal system, GALLOWAY does have the opportunity to earn a sentence reduction for good behavior. However, this reduction will not exceed 15% of the overall sentence.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
