Fresno Felon Sentenced for Illegal Firearms Possession for a Fourth Time in Less Than a Decade
FRESNO, Calif. – United States Attorney Benjamin B. Wagner announced that today United States District Judge Anthony W. Ishii sentenced Vue Her, 27, of Fresno, to six years and nine months in prison for two counts of being a felon in possession of a firearm, one count of possession with intent to distribute methamphetamine, and for a supervised release violation on a prior felon-in-possession-of-a-firearm conviction.
This case was the product of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the California Highway Patrol, the Police Departments of Fresno and Clovis, and the Multi-Agency Gang Enforcement Consortium. The investigation and prosecution are part of Project SAFE Neighborhoods, a cooperative effort of federal, state and local law enforcement agencies aimed at combating firearms and violent crimes. Assistant United States Attorney Kimberly Sanchez is prosecuting the case.
According to court documents, in May 2010, Her’s supervised release for his 2008 felon in possession conviction was revoked, and he was sentenced to an additional nine months in prison and 27 months of supervised release for associating with a prohibited person.
According to court documents, on December 7, 2010, Her was involved in an incident where he ran from police dropping a loaded handgun. On January 20, 2011, he was ordered to remain in jail, but was mistakenly released from jail. An arrest warrant issued, and Her was then arrested on April 23, 2011 after again running from a car that police had stopped, throwing another loaded handgun. In addition, he possessing methamphetamine that he said he was going to sell. Her was convicted in 2005 for carrying a concealed weapon and in 2008, for being a felon in possession of a firearm. Her is a validated, self-admitted MOD gang member (a Hmong gang, Menace of Destruction) and has a prior felony conviction for carrying a concealed weapon.
In sentencing, Judge Ishii acknowledged that Her's prior history of convictions, gang affiliation, performance while on supervision, and repeated firearms offenses made the offense particularly serious.
