ATF Special Agent Will Clark Cleared
The following statement is from Thomas Brandon, Deputy Director, Bureau of Alcohol, Tobacco, Firearms and Explosives:
"Today, a jury sitting in the U.S. District Court for the Virgin Islands found ATF Special Agent William G. Clark did not use excessive force and was therefore not civilly liable in a shooting death on Sept. 7, 2008. ATF has been steadfast in its support of Special Agent Clark and whole-heartedly agrees with the jury's verdict.
"On that date in 2008, when confronted by a violent assailant, Special Agent Clark took immediate action to defend himself and others by discharging his firearm to stop the attack. He took immediate steps to render first aid and summon medical assistance. Regrettably, the assailant succumbed to his injuries.
"In 2009, an independent panel including law enforcement officers from agencies outside ATF unanimously concluded the shooting was justified. A criminal case was brought against Special Agent Clark in a Virgin Islands superior court, but was ultimately dismissed by a judge in 2010.
"The threat to personal safety that law enforcement employees carry every day to make communities safer and confront violent criminals is very serious. ATF remains unwavering in its efforts to protect the American people and to reduce the impact of violent crime. We look forward to working with our local and federal partners in the U.S. Virgin Islands."
