Military Recruiting Results: Recruiter Access to High School:
  • Section 503c of title 10 U.S.C. ("Access to Secondary Schools"), commonly referred to as the "Hutchinson Amendment," articulates the provisions of the law governing recruiter access to high school students and access to student directory information for military recruiting purposes.   • Section 9528 ("Armed Forces Recruiter Access to Students and Student Recruiting Information") of the Elementary and Secondary Education Act of 1965 (20 U.S.C. § 7908), as amended by the No Child Left Behind Act (NCLB) of 2001 (P.L. 107-110), stipulates the same requirements as the Hutchinson Amendment regarding recruiter access to high school students and access to directory information for military recruiting purposes. Recruiter Access to Colleges and Universities:
  • Section 983 of title 10 U.S.C. commonly referred to as the "Solomon Amendment," articulates the provisions of the law governing recruiter access to colleges and universities, access to students, and access to student directory information.
  • Schools Ineligible for Federal Funding: 
    • In accordance with section 983 of title 10, United States Code, and the rule codified at 32 CFR Part 216, the list of institutions of higher education that are ineligible for federal funding under this law and rule are published in the Federal Register.

      The Federal Register is published to identify institutions of higher education that are ineligible for contracts and grants by reason of a determination by the Secretary of Defense that the institution prohibits or in effect prevents military recruiter access to the campus, students on campus or student directory information. It also implements the requirements set forth in section 983 of title 10, United States Code, and 32 CFR Part 216.
