La Ley de Protección al Consumidor de Servicios
Telefónicos (TCPA, por sus siglas en inglés), Código de
Estados Unidos (U.S.C., por sus siglas en inglés) 47 §
227, prohíbe que los equipos de fax se usen para enviar
publicidad no solicitada. La TCPA prohíbe el uso de
“cualquier equipo de facsímil, computadora u otro
dispositivo para enviar publicidad no solicitada a un
equipo telefónico facsimilar”. La TCPA es aplicable
solamente a aquellos mensajes enviados por facsímil que
se consideran “publicidad no solicitada”. Esta
prohibición reglamentaria es aplicable a dicha
publicidad enviada tanto a números de fax residenciales
como comerciales.
En 2005, la Ley de Prevención de Fax Indeseable
enmendó la TCPA, para permitir que se enviara publicidad
no solicitada por fax a los individuos y empresas con
los cuales el remitente tuviera una relación de negocio
establecida (EBR, por sus siglas en inglés) y para
implementar un proceso mediante el cual el remitente
tendría que dejar de enviar dicha publicidad si el
destinatario así lo solicitara. El 5 de abril de 2006,
la Comisión adoptó ciertas normas para implementar la
Ley de Prevención de Fax Indeseable. Entre otras cosas,
el Código de Regulaciones Federales (C.F.R., por sus
siglas en inglés) 47 § 64.1200 exige que el remitente de
la publicidad por fax proporcione una notificación y la
información para que los destinatarios puedan ponerse en
contacto con su número de fax, y tengan la opción de no
recibir más transmisiones por fax procedentes de ese
remitente; y exige además, que el remitente cumpla con
estas solicitudes en un periodo de tiempo corto, que no
