Mexican National Pleads Guilty to Illegally Possessing Firearm
BOISE – Wilfredo Cuevas-Duran, 51, of Parma, Idaho, pleaded guilty today in U. S. District Court to being an alien in possession of a firearm, U.S. Attorney Wendy J. Olson announced.
According to the plea agreement, on May 18, 2011, agents from Immigration and Customs Enforcement's Enforcement and Removal Operations executed a traffic stop on Cuevas- Duran, based upon knowledge that he was in the United States illegally. At that time, Cuevas- Duran indicated a firearm was located in his vehicle. Agents seized a Colt Custom .38 super, semi-automatic pistol, along with three magazines and fourteen rounds of ammunition, from the vehicle. Because Cuevas was in the United States illegally and without permission, he was prohibited from possessing firearms.
The charge is punishable by up to ten years in prison, a maximum fine of $250,000, and up to three years of supervised release.
Sentencing is set for June 11, 2012, before U.S. District Judge Edward J. Lodge at the federal courthouse in Boise.
The case was investigated by the U.S. Immigration and Customs Enforcement's (ICE), Homeland Security Investigations (HSI), assisted by Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF).
