Using the Registered Trademark
Q: Is the trademark approved by USPTO? What has been trademarked?
A: As of July 3, 2012, the trademark is now approved
by USPTO. NIH Legal has informed OCPL that is not only appropriate
but advisable for us to use the registered trademark symbol ® or
the phrase “Registered, U.S. Patent and Trademark Office” or “Reg.
U.S. Pat & TM Off.” in conjunction with the NIH…TURNING
DISCOVERY INTO HEALTH standard word mark. The USPTO registration
number is 4,125,605.
Q: What is trademarked?
A: There are four classes of products governing
use as follows:
International Class 09: Downloadable electronic educational and professional publications, namely, newsletters, fact sheets, and brochures about a federally funded biomedical and scientific research facility and information about federally funded biomedical and scientific research on human health and human diseases.
International Class 16: Printed educational and professional publications, namely, newsletters, fact sheets, and brochures about a federally funded biomedical and scientific research facility and information about federally funded biomedical and scientific research on human health and human diseases.
International Class 35: Promoting research in the field of human health and human diseases through the support and coordination of research projects conducted by universities, hospitals, research foundations and businesses.
International Class 42: Providing biomedical and scientific information via a global internet web site related to the field of human health and human diseases.
Q: What are the next steps?
A: OCPL will continue to work with the NIH Office
of Legal Counsel on maintenance of the registration. That
process continues into 2022. Efforts will focus on providing a
case for continuous use and confirming the absence of challenges
to the claim of mark ownership.
Q: What should IC communications planners do?
A: Continue to disseminate the mark widely along
with the registered trademark symbol ® and/or the phrase, “Registered,
U.S. Patent and Trademark Office” or “Reg. U.S. Pat & TM
Off.” Alert us—and General Counsel—to unauthorized
or questionable use of the mark. Partners or collaborators should
use the mark only after OCPL and General Counsel have provided
written permission to do so.
