Legislation
No Child Left Behind made some changes to the scope of an ED-Flex State’s waiver authority. In particular, under the Education Partnership Act of 1999, as amended by NCLB, an ED-Flex State may not waive statutory or regulatory requirements relating to sections 1111 and 1116 of the Elementary and Secondary Education Act.
