Frenar cancelaciones de seguros
La Ley del Cuidado de Salud a Bajo Precio hace que los planes de salud dejen de cancelar su cobertura de seguro sólo porque usted o su empleador cometieron un error sin querer en su solicitud.
Qué significa esto para usted
Antes de la ley de cuidados de salud, si su compañía de seguros encontraba un error en la solicitud de seguro, la compañía de seguros podía "rescindir" sus beneficios; es decir, declarar su póliza inválida desde desde un principio. Su compañía de seguros podría además solicitarle que reintegre cualquier dinero que haya gastado en cuidados de salud.
Actualmente, un asegurador no puede rescindir su cobertura sólo porque cometió un error sin querer o no incluyó información que no es muy relevante sobre su salud.
Algunos detalles importantes
- Esta disposición se aplica a todos los planes de salud, ya sea que obtenga la cobertura a través de su empleador o la pague usted por su cuenta.
- This provision applies to plan years or policy years that begin on or after September 23, 2010. Para conocer cuándo comienza el año de su plan o póliza, comuníquese con su asegurador o administrador del plan.
- Su compañía de seguro puede rescindir su cobertura si falsifica información o no completa información relevante intencionalmente y puede cancelar su cobertura si no paga sus primas a tiempo.
- Su compañía de seguro debe enviarle una notificación con al menos 30 días de anticipación antes de rescindir su cobertura, para que pueda, en ese tiempo, apelar contra la decisión u obtener una nueva cobertura.
Ejemplo:
Cuando se le preguntó a Katy sobre "qué otros datos consideraba relevantes sobre su salud", se olvidó de mencionar sobre dos sesiones de terapia que había tenido 6 años atrás. A Katy se le diagnosticó más adelante cáncer de mama y presentó reclamaciones a su compañía de seguros para el tratamiento de su enfermedad. Luego de que Katy presentase su solicitud, su plan descubrió las dos sesiones de terapia. Antes de la aprobación de la nueva ley, el error que cometió Katy podría haber implicado la rescisión o cancelación retroactiva de su cobertura. Pero con la ley del cuidado de salud, el plan de seguro que tiene Katy no puede rescindir su cobertura, ya que ella no tuvo la intención de distorsionar la información.
