Complaint Process

Pursuant to 29 C.F.R., Part 1614, any civilian employee, former employee, or applicant who believes they have been discriminated against on the basis of race, color, age (40 and over), religion, sex (including sexual harassment), national origin, mental or physical disability, or reprisal for prior EEO involvement must contact the EEO counselor within 45 days of the alleged discriminatory incident. The counselor will attempt to resolve the complaint on an informal basis within 30 calendar days of initial contact.

All persons have the right to remain anonymous during the informal stage and to appoint a representative of their choice at any stage. If the counselor is unable to resolve the complaint, the complainant is given his/her right to file a formal complaint within 15 calendar days of receipt of the notice of final review. The complaint must be filled in writing and signed by the complainant.

A Notice of Receipt and a Notice of Acceptance/Dismissal will be prepared and sent to the complainant. If accepted, an investigator from the DoD, Office of Complaints Investigation, will be assigned to conduct an investigation and prepare a report which will be provided to the EEO office and the complainant. If the complaint is still not resolved, the complainant may request a decision by the Secretary of the Navy with or without a hearing before an Equal Employment Opportunity Commission Administrative Judge within 30 days of receipt of the investigative report. If the complainant is still not resolved after a decision by the Secretary of the Navy is received, the complainant has the right to file a civil action in U.S. District Court at anytime after 180 days have elapsed from filing the formal complaint. Filing a civil action will stop administrative processing of the complaint.
