COMMISSION MEETINGS

On June 15, the Commission held an Executive Session. Sunshine Act Notices for Executive Sessions are here.

On June 16, the Commission held an Open Audit Hearing on the Georgia Federal Elections Committee.

ADVISORY OPINIONS

Opinions Issued

AO 2010-07 (Yes on FAIR).  On June 14, the Commission approved Advisory Opinion Request 2010-07, concluding that Members of Congress may solicit unlimited donations on behalf of Yes on FAIR during the period before the initiative qualifies for the November 2010 general election ballot, and may solicit up to $20,000 from individuals after the initiative qualifies for the ballot. The Commission could not render an opinion as to whether Members of Congress may solicit funds outside the Act’s limitations and prohibitions after the initiative qualifies for the ballot.

Request Received

AOR 2010-11 (Commonsense Ten). On June 16, the Commission made public Advisory Opinion Request 2010-11, in which Commonsense Ten asks whether it may solicit and accept contributions from corporations and labor organization. Commonsense Ten is a Federal nonconnected political committee that intends to make only independent expenditures. The Commission must issue a response no later than 60 days after receipt of the complete request, or by August 16.

ENFORCEMENT

The Commission made public two closed cases this week. For more information, see the case documents in the Enforcement Query System.

MUR 6124 – Service Employees International Union SEIU on Political Education and Anna Burger, in her official capacity as treasurer. The Commission dismissed the case.

MUR 6002 – Freedom’s Watch, Inc. The Commission closed the file.

LITIGATION

SpeechNow.org v. Federal Election Commission. On June 11, the Commission filed a motion to alter or amend the judgment in the United States District Court for the District of Columbia to modify the final judgment to reflect the DC Circuit Court’s holding regarding the plaintiffs’ reporting obligations.

The Real Truth About Obama, Inc. v. Federal Election Commission. On June 17, the United States District Court for the Eastern District of Virginia granted a stay of proceedings on the merits of the case pending a decision from the Fourth Circuit on the plaintiff’s request for a rehearing on the court’s resolution of plaintiff’s preliminary injunction motion.

RULEMAKING AND AGENCY PROCEDURES

June 16: Public comments in response to the Notice of Proposed Rulemaking for Standards of Conduct were due. The two comments received can be viewed here.


OUTREACH

On June 17, Vice Chair Cynthia L. Bauerly met with elected officials, national and local political advisors and heads of nongovernmental organizations from several South American nations to discuss how the FEC administers and enforces federal campaign finance laws. The delegation, sponsored by the Department of State's International Visitor Leadership Program, was in Washington to study citizens' rights and responsibilities in civil society and democracy as defined and practiced in the United States.

On June 17, Deborah Chacona, Acting Assistant Staff Director of the Reports Analysis Division, Madelynn Lane, Authorized Branch Chief of the Reports Analysis Division, and Communications Specialist Myles Martin made presentations regarding recent changes to FEC regulations and the Reports Analysis Division’s FEC Report review process at the annual conference of the California Political Treasurers Association held in Washington, D.C.
