Section 106
Section 106 of the National Historic Preservation Act (NHPA) requires federal agencies to take into account the effects of their undertakings on historic properties and afford the Advisory Council on Historic Preservation (ACHP) a reasonable opportunity to comment on such undertakings. The procedures for how Federal agencies should carry out their Section 106 responsibilities are defined in the Code of Federal Regulations, Title 36, Part 800 (36 CFR 800).
The Section 106 process seeks to accommodate historic preservation concerns with the needs of federal undertakings through consultation among the agency official and other parties with an interest in the effects of the undertaking on historic properties. The goal of consultation is to identify historic properties potentially affected by the undertaking, assess its effects and seek ways to avoid, minimize or mitigate any adverse effects on historic properties.
The San Ysidro Land Port of Entry (LPOE) expansion project is considered an undertaking according to 36 CFR 800 and thus is subject to review under Section 106. GSA, as the lead agency in this undertaking, has initiated the Section 106 consultation for this project.
