ANTITERRORISM AND EFFECTIVE DEATH PENALTY ACT OF 1996

Public law which instructed the DHHS Secretary to develop a list of select biological agents which could be used as a weapon of terror or cause mass casualties. This law further instructed the DHHS Secretary to develop regulations for the enforcement of safety procedures for the transfer of biological agents, to prevent access to such agents for use in domestic or international terrorism or for any other criminal purpose, and the establishment of procedures to protect the public safety in the event of a transfer or potential transfer of a biological agent in violation of the safety procedures.

THE USA PATRIOT ACT OF 2001

Amends Section 175 of the U.S. Criminal Code to allow prosecution of individuals who knowingly possess any biological agent, toxin, or delivery system of a type or quantity not reasonably justified by prophylactic, preventative, bona fide research or other peaceful purposes.

THE PUBLIC HEALTH SECURITY AND BIOTERRORISM PREPAREDNESS RESPONSE ACT OF 2002

Requires all persons in possession of any "Select Agent" to notify the Secretary of DHHS by September 10, 2002. The law also requires individuals in possession of "High Consequence" livestock pathogens or toxins and "Select" Plant Pathogens to notify the Secretary of Agriculture by October 8, 2002.
