Lactation Space Support

The 2010 Patient Protection and Affordable Care Act (Act), Pub. L. 111-148 added a new subsection (r) to section 7 of the Fair Labor Standards Act of 1938 (FLSA) (codified as amended at 29 U.S.C. 207).  This new section requires an employer to provide employees with (1) a reasonable break time to express breast milk for her nursing child for 1 year after the child's birth each time such employee has need to express milk; and (2) a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public which may be used by the employee to express breast milk.  GSA provides the following guidance to assist agencies with meeting this requirement.

Additional information on lactation rooms and lactation support services is provided by the Office of Personnel Management and the Centers for Disease Control.
