DIVERSITY IN MISSION, VERSATILITY IN PRACTICE

Welcome to the ENRD, Natural Resources Section (NRS). The docket of the Natural Resource Section (NRS) is a kaleidoscope of diverse and challenging resource issues ranging from litigation to protect such national treasures as Florida’s Everglades and the remnant old-growth forests of the Pacific Northwest, to protecting the federal interest in the country’s vital water resources, to defense of the public fisc against claims by private property owners for alleged “takings” and by Native Americans for alleged trust breaches. And by virtue of our responsibility for all litigation under the National Environmental Policy Act, we defend the decision-making processes of virtually every federal agency.

Our practice involves:

  • litigation in both Federal and State Courts;
  • emergency litigation defending against temporary restraining orders and preliminary injunctions;
  • defense of the decisions of administrative agencies in accordance with the review standards of the Administrative Procedure Act;
  • original actions in the Supreme Court, tried before a Special Master;
  • trial and pre-trial practice in inverse condemnation, water rights, and Indian trust cases, with emphasis on the preparation of expert testimony; and
  • the panoply of negotiation and alternative dispute resolution processes that arise through litigation
