MIAMI DME OWNER SENTENCED FOR MEDICARE FRAUD

FOR IMMEDIATE RELEASE

R. Alexander Acosta, United States Attorney for the Southern District of Florida, and Jonathan I. Solomon, Special Agent in Charge, Federal Bureau of Investigation, Miami Field Office, announced today's sentencing of defendant Michael Miranda. Miranda was sentenced by U.S. District Court Judge Adalberto Jordan to 366 days' imprisonment, to be followed by one year of supervised release. In addition, the defendant paid $142,707 in restitution at the time of his sentencing.

According to the Information and the factual proffer read in open court at the time of the plea, on May 27, 2004, the defendant became the owner of L&L Medical Equipment Inc. (L&L Medical), a Florida corporation that purportedly provided durable medical equipment (DME) to Medicare beneficiaries in Miami-Dade County. The defendant submitted documents to Medicare, stating that he was the party responsible for billings submitted by L&L and that he was a signatory to L&L's corporate bank account. Investigation revealed that once the defendant took over L&L, the company billed Medicare $1,064,778 for services that were not provided to Medicare beneficiaries. As a result of these fraudulent claims, Medicare paid L&L approximately $142, 707.

Acosta commended the investigative efforts of the Federal Bureau of Investigation, Miami Field Office. This case was prosecuted by Assistant United States Attorney Daniel Bernstein.
