SUBJECT: INFORMATION: Preliminary SAFETEA-LU Guidance - Annual List of Obligated Projects
FROM: Gloria Shepherd
TO: Attention of FHWA Division Office Planning Staffs
DATE: Friday, February 24, 2006

The purpose of this message is to transmit FTA/FHWA Preliminary Guidance on Annual Listing of Obligated Projects. The SAFETEA-LU required rulemaking on this requirement within 180 days of the August 10, 2005 enactment date, specifying the types of data to be included in the list. Rather than issuing a separate regulation on the topic, however, we intend to include it in the draft Notice of Proposed Rulemaking (NPRM) prepared for publication at a later date in the Federal Register.

To facilitate early transition to SAFETEA-LU by States, Metropolitan Planning Organizations (MPOs), and transit operators in metropolitan and statewide planning processes before that rulemaking, we have prepared the attached guidance for your use and dissemination to States, MPOs, transit operators, as well as the stakeholder community. This guidance is based exclusively upon the planning provisions set forth in statute and includes illustrative examples drawn from current practice. The guidance is labeled "preliminary" because an update is envisioned when planning regulations containing more descriptive detail are finalized.

Development of this guidance was a collaborative effort among FTA and FHWA planning staff. We welcome all comments, questions, and points of clarification, as well as referrals to other examples in current practice that illustrate the concept

If you have any questions, please call me or John Humeston at (404) 562-3667.
