Results of Eighth Army Court-Martial Convictions for June 2012
At a SPCM BCD Court-Martial on 6 June 2012, PFC Mario A. Beltran, C Company, 1st Brigade Special Troops Battalion, 1st Brigade Combat Team, 2d Infantry Division, APO AP 96224, was found guilty of desertion, in violation of Article 85, UCMJ; three specifications of going AWOL, in violation of Article 86, UCMJ; failing to report, in violation of Article 86, UCMJ; violating a lawful general order by wrongfully possessing a prohibited substance, in violation of Article 92, UCMJ; wrongfully possessing a controlled substance, in violation of Article 112a, UCMJ; wrongfully distributing a controlled substance, in violation of Article 112a, UCMJ; two specifications of breaking restriction, in violation of Article 134, UCMJ; and wrongfully using another’s identification card, in violation of Article 134, UCMJ. He was sentenced to 150 days of confinement, reduction to the grade of E-1, and to be discharged from the service with a Bad-conduct Discharge.
At a General Court-Martial on 12 through14 June 2012, SFC James O. Mathis, Headquarters and Headquarters Company, 1st Brigade Combat Team, 2d Infantry Division, APO AP 96224, was found guilty of three specifications of making false official statements, in violation of Article 107, UCMJ; and larceny of more than $500.00, in violation of Article 121, UCMJ. He was sentenced to 15 months of confinement, reduction to the grade of E-3, and to be discharged from the service with a Bad-conduct Discharge.
At a General Court-Martial on 21 June 2012, Sergeant Wesley Stewart, D Battery, 2nd Battalion, 1st Air Defense Artillery, 35th Air Defense Artillery Brigade, was found guilty of Aggravated Sexual Assault, in violation of Article 120, UCMJ; Adultery, in violation of Article 134, UCMJ, Insubordinate Conduct Toward a Noncommissioned Officer, in violation of Article 91, UCMJ; and Failure to Obey a Lawful General Regulation, in violation of Article 92, UCMJ. He was sentenced to confinement for five years and to be dishonorably discharged from the service.”
At a General Court-Martial on 27 June 2012, Sergeant Lester Encalade, Headquarters and Headquarters Battery, 2nd Battalion, 1st Air Defense Artillery, 35th Air Defense Artillery Brigade, was found guilty of Forcible Sodomy, in violation of Article 125, UCMJ; Aggravated Sexual Assault, in violation of Article 120, UCMJ; Wrongful Sexual Contact, in violation of Article 120, UCMJ; and Failure to Obey a Lawful General Regulation, in violation of Article 92, UCMJ. He was sentenced to a reduction to the grade of E-1, total forfeiture of all pay and allowances, confinement for twenty-one months, and a Bad Conduct Discharge.”
At a Summary Court-Martial on 6 June 2012, PFC Victoria L. Gladney, Headquarters and Headquarters Company, 302d Brigade Support Battalion, 1st Brigade Combat Team, 2d Infantry Division, APO AP 96224, was found guilty of failing to pay a just debt, in violation of Article 134, UCMJ. She was sentenced to reduction to the grade of E-2 and 45 days hard labor, without confinement.
At a Summary Court-Martial on 28 June 2012, PV1 Gilberto Floresramos, Headquarters and Headquarters Battery, 1st Battalion, 15th Field Artillery, 1st Brigade Combat Team, 2d Infantry Division, APO AP 96224, was found guilty of conspiracy to use another’s military identification card to gain access to a military installation, in violation of Article 81, UCMJ; violating a lawful general order by consuming alcohol under the age of 21, in violation of Article 92, UCMJ; and wrongfully using another’s identification card, in violation of Article 134, UCMJ. He was sentenced to forfeiture of $994.00 pay for 1 month, 45 days restriction, and 45 days of hard labor, without confinement.
Results of ROK Criminal Prosecutions for June 2012
In Suwon District Court on 1 June 2012, MSG Ricardo Fantauzzi, A Co, 2-2 Assault, USAG-Yongsan, was convicted of DUI. His adjudged sentence was a 3,000,000 Won fine.
In Uijeongbu District Court on 5 June 2012, SFC Cleveland T. Rogers, C Troop, 4/7th Cavalry, USAG-Casey, was convicted of DUI. His adjudged sentence was a 2,000,000 Won fine.
In Seoul Central District Court on 8 June 2012, SPC Gary L. Ford, Jr., E Co, 302d BSB, USAG-Casey, was convicted of making and uttering counterfeit bank notes. His adjudged sentence was imprisonment for 1-1/2 years, suspended for 3 years and a fine of 3,000,000 Won.
In Uijeongbu District Court on 25 June 2012, PVT Jon E. Meyer, A Co, 2/9th Infantry, USAG-Casey, was convicted of Larceny and Driving Without a Valid License. His adjudged sentence was a 3,000,000 Won fine.
In Seoul Central District Court on 27 June 2012, SGT Benjamin J. Wardropper, HHB, 8th Army (I&S Co), USAG-Yongsan, was convicted of traffic law violations. His adjudged sentence was imprisonment for 8 months, suspended for 2 years.
In Seoul Central District Court on 28 June 2012, 2LT Won Choi, UNC Honor Guard Co, USAG-Yongsan, was convicted of Destruction and Damage of Property. His adjudged sentence was a 500,000 Won fine.
