BOSTON - As part of a large-scale investigation into gun and drug trafficking, and other gang-related activities in Fitchburg, a local man was convicted today of distributing crack and heroin.
Danny Diaz, 25, of Fitchburg, pleaded guilty before U.S. District Judge F. Dennis Saylor, IV to five counts of distribution of crack and/or heroin.
From June to December 2011, Diaz engaged in five sales of crack and/or heroin to a cooperating witness in Fitchburg. In total, Diaz sold 59.3 grams of crack and .31 grams of heroin.
Judge Saylor scheduled sentencing for Sept. 18, 2012. Diaz faces a minimum mandatory sentence of five years and up to 40 years in prison, to be followed by supervised release of at least four years, a fine of up to $5 million. However, if the court accepts the parties’ plea agreement, Diaz will be sentenced to a term of either 70 or 84 months in prison to be followed by four years of supervised release and a fine, unless the court determines that Diaz cannot afford to pay one.

The case is being prosecuted by Assistant U.S. Attorney Karin M. Bell of Ortiz’s Worcester Branch.
