HOME Waiver Log: 2000

The following summaries provide information on the date that HOME waivers were granted and denied, the State or Local Field Office making the request, the situation which gave rise to the need for a program waiver, and the regulatory citation. 2/25/2000 FL Conditional waiver granted, extending expenditure deadline for Dade County’s remaining 1993 HOME disaster funds. Approval of waiver request conditioned upon the County’s provision of a project status report on funds already expended and a detailed description of how the County intends to expend its remaining disaster funds, with an accompanying timetable and project completion schedule. 92.500 (d)(1)(c)
3/1/2000 PA Waiver granted extending the purchase deadline for HOME-assisted lease-purchase program from 36 to 48 months as a result of undue financial/credit problems facing homebuyers. 92.254(a)(5)(ii) (A)(7)
3/1/2000 MN Waiver granted permitting the State to provide CHDO operating funds to nonprofit organizations that do not use set-aside funds, but own, sponsor, or develop affordable housing using other funding sources. 92.300(e)
3/8/2000 ME Waiver granted permitting the State to use HOME funds for the acquisition and rehabilitation of two separate properties to be used as residential child care facilities for developmentally disabled children. While granting the waiver, the Department maintains that the facilities do not meet the definition of housing established at §92.2 of the HOME final rule. 92.2
3/28/2000 CA Waiver granted allowing the State to retain $50,000 in HOME disaster funds after the 5-year expenditure deadline had expired. This amount was requested to fund ongoing administrative costs related to projects previously funded with HOME disaster grants. The State’s remaining disaster balance will be deobligated.

5/04/2000 CA Waives the requirement that a PJ may only invest HOME funds in eligible projects within its boundaries or joint projects within contiguous local jurisdictions, in order to assist low-income homeowners who must vacate their homes because of erosion caused by a natural disaster. The high cost of homeownership housing within the county makes it difficult to find affordable replacement housing. 92.201(a)(2)
6/14/2000 CA Waiver granted permitting the Cedarbrook project to proceed, and allowing HUD to release funds for this project. The San Francisco Office had originally objected to the RRF because it appeared as though the State had signed an agreement with the developer that had legally committed HUD funds to the project regardless of the outcome of the pending environmental review. OGC concluded that "the agreement may be considered as not constituting a "commitment of funds" made before the State requested the release of funds for this project." 24 CFR 58.40(f)
7/20/2000 KY Waiver granted to Kentucky Housing Corporation, relieving it from obligation to repay program funds invested in project that was terminated before completion. The homeowner died prior to the completion of the rehabilitation work on her home. 92.205 (e) 92.503(b)(2)
8/7/2000 KY Waiver granted permitting Kentucky Housing Corporation to fund a homebuyer assistance program with HOME, providing homebuyers with less than the $1,000 minimum investment normally required in HOME projects. KHC maintains that many of the homebuyers they serve need less than $1,000 to purchase a home, but without the subsidy they would not be able to make the purchase at all. 92.205
8/14/2000 KY Denial of waiver request submitted by Kentucky Housing Corporation (KHC). A State recipient had invested HOME funds in the construction of an affordable unit, but had placed affordability requirements on the unit as stipulated at 92.254(a)(5). The State was required to recapture the entire original HOME investment, and use these funds to reimburse its HOME account. 92.503(b)(1)
8/14/2000 ND Waiver granted permitting the State to provide emergency housing assistance with HOME funds in federal disaster area without having to meet property standard requirements at §92.251. 92.251
8/25/2000 IL Request from Champagne County Consortium denied. Consortium had asked the Department to allow one of its members (Rantoul) to continue to operate its CDBG and HOME programs within annual cycles with different beginning and end dates than that of the consortium’s consolidated program year. The Department required the village to align its program year with that of the consortium. 91.402(a)
8/31/2000 UT Waiver granted permitting City of Taylorsville to use HOME funds to purchase a plot of land within its boundaries, but which is owned by Salt Lake County. 92.214(a)(8)
8/31/2000 CO Waiver of HOME property standard requirements for State of North Dakota for HOME funds used to perform emergency repairs on homes located within a Federal disaster area. 92.251
9/13/2000 KY Waiver request denied. City of Guthrie had failed to apply required resale restrictions on HOME-assisted unit, which was subsequently sold within the period of affordability. 92.503(b)(1)
11/13/00 FL Waiver request denied. State had requested permission to divert the remaining balance of its 1994 HOME disaster relief allocation ($2,650,401.51) from its disaster account to its entitlement account. The State proposed to use the remaining funds to finance a first-time homebuyers bond program and a homeownership construction program. HUD found the proposed use of funds to be inconsistent with the purposes for which the funds were originally appropriated. 92.503(b)(1)
12/5/00 AL Waiver request denied. State had requested a six-month extension of a match reduction granted within a Federally-declared disaster area. A project that had commenced during the original match reduction period was still under development at the time that the match reduction period had expired. Waiver denied based on the expiration of the declaration of disaster in this part of the State. 92.218
