Heroin Dealer and Child Rapist Caught

Gallup, NM - On October 6, 2011 Deputies and Sex Offender Investigators from the United States Marshals Service Southwest Investigative Fugitive Team (SWIFT) Task Force and members from the Gallup Police Department arrested Rocky Rubio (32) in Gallup NM. Rubio was wanted by authorities in Arizona for selling heroin to a 16 year old female then raping her. The girl died shortly after Rubio raped her from a heroin overdose.

According to investigators on July 4, 2011 the 16 year old female and a 14 year old female, contacted Rubio to purchase heroin. Allegedly Rubio (32) met up with the two teenagers and sold them $20.00 of black tar heroin. Then investigators believe Rubio used heroin with the 16 year old girl and had sex with her. Sometime after Rubio left the residence the 16 year old female injected a fatal dose of heroin, and was found unresponsive the next morning. She was pronounced dead shortly after emergency services arrived on scene July 5, 2011.

Authorities believed Rubio had fled in fear of prosecution and Arizona Authorities sought the help of the United States Marshals Service Child Predator Apprehension Team (CPAT) in Arizona. Deputies with CPAT developed leads that Rubio had absconded across state lines into New Mexico and referred the case to Deputies and Sex Offender Investigators from the United States Marshals Service, District of New Mexico, Southwest Investigative Fugitive Team (SWIFT). Conrad E Candelaria, United States Marshal for the district of New Mexico “the Marshals Service will use all the necessary resources to pursue predators such as Rubio so that justice can hold them accountable for their unconscionable crimes that have caused pain and suffering.” Rubio was believed to be hiding out in Gallup, NM and was apprehended by members of the United States Marshals Service and the Gallup Police Department on evening of October 6, 2011.
