COMMISSION MEETINGS

ENFORCEMENT

The Commission made public four closed cases. For more information, see the case documents in the Enforcement Query System.

MUR 6256 – Michael Babich. The Commission found no reason to believe the respondent violated the Act regarding three allegations and dismissed one allegation.

MUR 6253 – Harold W. (Trey) Gowdy III; Trey Gowdy for Congress and Marvin Quattlebaum, in his official capacity as treasurer; Gowdy State Solicitor Committee; and Under the Power Lines. The Commission found no reason to believe violations occurred in connection with two allegations and dismissed one allegation concerning Gowdy and Gowdy State Solicitor Committee. The Commission found no reason to believe violations occurred in connection with two allegations and dismissed two allegations concerning the Trey Gowdy for Congress and its treasurer. The Commission found no reason to believe a violation occurred concerning Under the Power Lines.

MUR 6263 – The Committee to Re-Elect Artur Davis to Congress and Byron Perkins, in his official capacity as treasurer; Artur Davis 2010; and Katie Baker. The Commission found no reason to believe the respondents violated the Act.

MUR 6318 – Earl Henry Sholley for Congress and Ronald A. Gengo, in his official capacity as treasurer; and Earl Henry Sholley. The Commission dismissed the case.

LITIGATION

The Real Truth About Obama, Inc. v. FEC.  On October 18, the Commission filed in the United States District Court for the Eastern District of Virginia its Motion for Summary Judgment and Opposition to Plaintiff's Motion for Preliminary Injunction and Summary Judgment. On that same day, defendant U.S. Department of Justice also filed a Motion of Summary Judgment and Opposition to Plaintiff’s Motion for Preliminary Injunction and Summary Judgment. On October 19, the District Court issued an order granting the Plaintiff’s unopposed motion to consolidate the hearings on the summary judgment and preliminary injunction motions. On the same day, the Court set the hearing on the motions for January 13, 2011. 

Robinson Committee, LLC and Jack E. Robinson v. FEC. On October 19, the Commission filed in the United States District Court for the District of Massachusetts a Motion for Leave to File a Reply in Support of Its Motion to Dismiss, as well as a supporting Memorandum.

SpeechNow.org v. FEC. On October 14, the Petitioners filed a reply brief in the Supreme Court of the United States. 

OUTREACH

On October 21, Vice Chair Cynthia L. Bauerly met with representatives from the Organization for Security and Cooperation in Europe's Office for Democratic Institutions and Human Rights to discuss the Commission's role in enforcing campaign finance regulations.

LAUNCH OF NEW DISCLOSURE INITIATIVES

This week, the Commission introduced a new, searchable feature on its website allowing real-time, comprehensive disclosure of independent expenditures in the 2010 federal campaign. The file contains detailed information about independent expenditures, including who was paid, the purpose of the disbursement, date and amount of the expenditure and the candidate for or against whom the expenditure was made.
