Huron Man Pleads Guilty to Firearms Charges

St. Paul – US Attorney Brendan V. Johnson announced that Martin Rios, Jr., age 25, of Huron, appeared before US Magistrate Judge John E. Simko on September 12, 2012, and pled guilty to an indictment that charged him with being a felon in possession of a firearm. The maximum penalty upon conviction is 10 years in prison and/or a $250,000 fine, plus forfeiture of the firearm.

Rios was found by law enforcement to be in possession of a .40 caliber semiautomatic Hi Point pistol. He is a felon, having been convicted of attempted murder in Texas, and is therefore prohibited from possessing firearms.

The investigation was conducted by the Huron Police Department, the South Dakota Division of Criminal Investigation, and the Bureau of Alcohol, Tobacco, Firearms & Explosives. The case is being prosecuted by Assistant US Attorney John E. Haak.

A presentence investigation was ordered, and a sentencing date will be set. The defendant was remanded to the custody of the State of South Dakota pending sentencing.
