In re Stancil (Bankr. D. D.C.)

OPINION – Debtor and his mother filed a joint bankruptcy petition. Only spouses are allowed to file jointly, so a creditor who foreclosed during the automatic stay argued that there was no stay because there was no valid petition. However, the joint petition showed intent for each to file as of that date. A stay arose as to debtor on the date of filing the (later separated) joint petition.

In re South Side House LLC (Bankr. E.D.N.Y.)

OPINION – In this single asset real estate case, the post-petition rent payments are adjudged to be the property of the estate and constitute the lender’s cash collateral. Monthly payments to the lender will apply to the non-secured portion of the claim until that balance is zero, then apply to post-petition interest and fees allowed under 11 U.S.C. 506(b).

MEMORANDUM - Debtor was not allowed to discharge judgment against him for sexual harassment; an individual debtor may not receive a discharge from any debt for willful and malicious injury by the debtor.
