Job Description:
Serves as both a hearings examiner and as an advisor to the General Counsel and Commission regarding matters within the jurisdiction of the Commission’s Surface Mining and Reclamation Division. Acts as a hearings examiner conducting hearings involving new permits, applications for renewal, revision, bond release and enforcement within the Commission’s coal, uranium, and iron ore mining jurisdiction. Must possess a comprehensive knowledge of administrative procedure, State and Federal mining laws, and the rules of evidence. Analyzes evidence, drafts recommendations and orders for Commission action. Above average writing and communication skills required to prepare clear and concise reports with findings of fact, conclusions of law, and recommended orders or actions. Presents recommendations to the Commission both orally and in writing. Drafts notices of hearing and summaries of decision. Prepares, as necessary, subpoenas requiring the appearance of witnesses, records and documents for Railroad Commission hearings. Assists in coordinating legal functions of the Hearings Section with the Surface Mining and Reclamation Division. Must interact effectively with Commissioners, division staff and public and private groups and organizations regarding surface mining and procedural issues. Prepares legal opinions and memoranda regarding the constitutional and statutory duties and responsibilities of the Surface Mining and Reclamation Division. Reviews and advises the General Counsel of relevant changes or proposed changes in federal and state regulations, and coordinates, as necessary, with the Surface Mining and Reclamation Division Director. Responds to inquiries from industry and the general public in a professional and courteous manner. Additional tasks may be assigned.
Minimum Qualifications:
Licensed to practice law in the State of Texas and at least 72 months administrative law or litigation experience. Prefer applicant with surface mining industry experience or other administrative regulatory experience.
Remarks (Application procedure, Special requirements):
Salary is up to $72,000 per year / $6,000 per month depending on experience and qualifications. Candidates with less than the posted experience may be considered at a salary commensurate with their experience. Word processing skills required. A writing sample should be submitted with the application.
