Gabriela Aguilar, the former business office manager of Brookshire Nursing Center, located in Waller County, pled guilty on May 7, 2007, to charges of misapplication of fiduciary property and was sentenced to 60 days in county jail, 10 years probation, 240 hours of community service and was ordered to pay more than $32,000 in restitution. In addition, Aguilar was ordered to attend an 8-hour course addressing theft. On April 11, 2006, Aguilar was indicted for theft and misappropriation of fiduciary property, both second-degree felonies, for stealing $32,439.65 from residents' trust fund accounts between Aug. 2003 and Sept. 2004. The Medicaid Fraud Control Unit arrested Aguilar on April 13, 2006, at her residence in Houston. The Waller County District Attorney's Office asked the Office of the Attorney General to prosecute the case. In a separate case, Aguilar was indicted in Harris County for felony theft/misapplication for taking $4,350 from the Houston-based Briarwood Health Care Center's trust fund account for residents. That case is pending.
