Special Education Complaints Resolution Process

When should you file a complaint?
If you believe the school has violated federal or state requirements related to special education, you may file a complaint with the Texas Education Agency. You may choose to request mediation or file a due process hearing through the Texas Education Agency to resolve your disupte with the school .

How to file a complaint?
In order for the TEA to conduct an investigation, your complaint must be written and signed. It must state the violations you believe have occurred and state the facts on which your complaint is based. A complaint form is available in English and Spanish for your use. You do not have to use this form to file a complaint; however, all complaints must be written and signed.

In addition, whether you use the complaint form or write your own letter, you are required by law to send a copy of your complaint to the school district. A checklist has been developed to ensure you submit all required information in order for the Division of IDEA Coordination to investigate your special education complaint.
