Transactions and Signed Records
T.A.C. §203 Management of Electronic Transactions and Signed Records was initially adopted in May 2003. In October 2004 the DIR Board approved a new version that included the provisions of T.A.C. §201.14 Digital Signature rule. The new version of the rule was published in the September 10, 2004 edition of the Texas Register. A copy of the Texas Register posting is available from the Secretary of State. The rule adopts the "Guidelines for the Management of Electronic Transactions and Signed Records" that were developed by the Uniform Electronic Transactions Act (UETA) Task Force.
The Digital Signature legislation was enacted in 1995, and was technology specific for high risk transactions. The UETA legislation was enacted in 1999 and is technology neutral, and covers low, medium, and high risk transactions. The risk assessment procedures in the "Guidelines for the Management of Electronic Transactions and Signed Records" apply to all three levels of risk and should be used if an organization is considering a specific technology for an electronic transaction.
In 2004 the guideline was updated to include new documents based on the Federal Government E-Authentication Initiative and the Electronic Authentication Partnership (EAP).
