Filing Fees in Civil Cases

First Court of Appeals


The following filing fees in civil cases are set by Government Code sections 51.207, 51.208, 51.941(a), and 101.041 and the Texas Supreme Court's August 28, 2007 Order Regarding Fees Charged in Civil Cases in the Supreme Court and the Courts of Appeals and Before the Judicial Panel on Multidistrict Litigation:

   
Appeal from district or county court $175.00
Original proceeding $125.00
Motion other than for rehearing or en banc reconsideration $10.00
Motion for rehearing or motion for en banc reconsideration $15.00

Make money orders or checks payable to "Clerk, First Court of Appeals." The State and political subdivisions of the State are exempt from the advance payment of filing fees. Op. Tex. Att'y Gen. No. DM-459 (1997).

There is only one $175.00 filing fee for each civil case on appeal, regardless of how many appellants there may be or the number of notices of appeal that are filed. See Tex. Gov't Code Ann. §§ 51.207, .941(a) (Vernon 2005). If there are multiple appellants that are not indigent or exempt, those appellants must determine amongst themselves how the filing fee will be paid.
