Juveniles Certified as Adults by Offense

In Texas, a juvenile who commits a Capital or First Degree Felony at the age of 14, or who commits any felony at age 15 or 16, may be certified by a juvenile court to stand trial in an adult court. This is commonly referred to as "certification."

Certifications dropped in the mid-1990s through 2001, but rose again in 2002.

An alternate to certification in Texas is the use of determinate sentencing, which provides for the sentence to begin in the juvenile corrections system (the Texas Youth Commission), with possible transfer at a later date to the adult prison system.

   * Prior to 1997 Attempted Homicides were included in Aggravated Assaults.

Conclusions:
  • Certifications of juveniles as adults doubled between 1988 and 1992, more than doubled again between 1992 and 1994, but then were reduced by 76% from 1994 to 2001, then resurged by 52% in 2002, but returned to approximately its 2001 level in 2003.

  • Certifications for homicide were reduced by 57% from 1997 to 2003.
