Hiring an Attorney

As an injured employee in Texas, you have the right to hire an attorney to assist you on your workers' compensation claim. 

The Texas State Bar offers information to help you select an attorney

If you have a dispute in your claim, it might go through one or more steps in the Division of Workers' Compensation's hearings process, including:

- Benefit Review Conference
- Contested Case Hearing
- Appeals Panel Review
- Judicial Review:  If you are not satisfied with the final decision of the Division of Workers' Compensation, you may appeal the decision to the district court or the county court at law in the county where you live.  The petition must be filed not later than the 40th day after the date on which the decision of Appeals Panel or the notice that the hearing officer's decision is final is filed with the Division of Workers' Compensation.  The Office of Injured Employee Counsel is not able to help you at this level.  You will likely need to hire an attorney or chose to represent yourself at this stage of the process.
