Standing
Application & Examination Policies:
-
Applicants must review their application
to ensure accuracy/completion
prior to submission to avoid
processing delays.
This is the
applicant's responsibility!
Incomplete or deficient applications are
subject to return/rejection.
-
Applicant appearance at the exam site
will constitute an agreement to the
terms of these policies.
-
The filing of an application and
tendering of fees does not in any way
obligate the Board to admit the
applicant to examination until such time
the applicant has been approved as
meeting all requirements for licensure
set forth in the Board's laws and rules.
No examination fee will be refunded.
-
Applicants who have furnished false
information to the Board or who are
alleged to be in violation of the
Board's laws and rules will be
investigated. Such applicants are
subject to refusal for admittance to the
examination and denial of licensure;
Board disciplinary action.
-
Applicants permitted to take the
examination are subject to the laws and
rules of the Board and to the following
conditions. The Board reserves the
right to refuse an applicant admittance
to the exam if other information comes
to our attention prior to the
examination date that necessitates
barring the applicant from the
examination. Furthermore, admittance to
the examination is not intended and
shall not be construed to imply or
constitute a finding of the Board
regarding the applicant’s fitness to sit
for the examination nor as an approval
of an application for license after the
examination, regardless of the
applicant’s performance on the exam.
- The
deadline for application submissions
will be 60 (sixty) days prior to the examination
date to allow for state/federal criminal
history checks. Once tendered, all fees
are non-refundable.
-
Applications are valid for 1 (one) year from
the date of submission.
- If the
applicant can not be present for their
scheduled examination, he/she must
notify the Board in writing PRIOR to the
examination to carry forward the
application and fee to the next
examination date. Failure to notify the
Board in advance will result in the
initial fee not being carried forward
and re-submission of application fee.
- An
applicant who fails to appear for
examination without prior notice to the
Board and who wishes to appear for
future examination with a fee waiver,
may be excused for illness, death in the
immediate family, disabling traffic
accident, court appearance, jury duty,
military duty or other extenuating
circumstances beyond the control of the
applicant. The applicant must submit to
the Board a sworn/notarized affidavit
stating the reasons for failure to
appear. The applicant may also include
any supporting documentation.
-
Applications which have been held over
from prior examination filings may be
required to have certain information
current (e.g. Main Application;
Certification Letters from other states;
Current CPR; Current Photo; NPDB-HIPDB
Self Query Report and supporting
Affidavit; FBI/DPS fingerprint cards and
fee or any other items that may be
required at the time of application).
Each application will be considered on a
case-by-case basis on which materials
are to be re-submitted.
Examination Study Materials:
-
Applicants will be tested on
"Texas Occupations Code, Chapter 202"
(Statute) and "Title 22-Part 18 Texas
Administrative Code" (Rules)

materials.
-
Applicants may also request a printed
copy of these Laws/Rules at cost
($20.00) to the agency by contacting
Janie Alonzo, Staff Services Officer.
- Although the entire Podiatric
Medical Practice Act (Texas Occupations
Code, Chapter 202), the Board Rules
(Texas Administrative Code; Title 22,
Part 18) and related other
State/Federal Laws/Rules are quite
extensive, from a "complaint" prevention
perspective, it would be in a licensee’s
best interest to be aware of the
following BOARD STATUTE & RULES.

NOTE: Formal “Disciplinary Actions”
(Board Orders) are reported to the
National Practitioner
Databank-Healthcare Integrity Protection
Databank (NPDB-HIPDB) and on the Board's
website. This PDF document is NOT
an inclusive "Study Guide."
License Activation Policies:
- Upon successfully passing the examination, an
applicant is given a "New" designation
and then shall submit a fee for an
"Active" license in order to lawfully
practice podiatric medicine in the State
of Texas. Practice without activating a
license is a CRIMINAL ACT in violation
of Texas Occupations Code
§202.605
"General Criminal Penalty: Practice
Without License."
-
If a "New" license is not activated
within one year of examination date, the
license will be "Cancelled." The
applicant is then required to re-submit
the entire application and applicable
fees for licensure which includes
re-taking the examination.
