Case No. CIV 96-196 B

STIPULATED MOTION FOR EXTENSION OF TIME

The United States hereby respectfully requests that this Court extend the time for it to file a Reply to defendants' response to the United States' motion for summary judgment up to and including January 9, 1998. This is the United States' first request for such an extension in this case.

On November 13, 1997, the United States filed a dispositive motion for summary judgment. After receiving a 15-day extension, defendants served their response by mail on December 11. The United States received that response today, December 17. An extension is necessary and appropriate given the lateness of actual service, the upcoming holidays, and the importance of the motion. Defendants' counsel stated that he has no objection to an extension.

    Respectfully submitted,
